1. Purpose

This Business User Policy outlines Medical Pharma Services, s.r.o.'s commitment to ensuring fairness, transparency, and compliance with Regulation (EU) 2019/1150 for business users of our online intermediation services or search engine platform, MphaR Virtual Advisory Board Platform. This policy details how we manage search rankings, data access, account termination, and dispute resolution to promote a fair and transparent environment for all business users.

2. Scope

This policy applies to all business users who:

  • Have their place of establishment or residence in the European Union.
  • Use MphaR Virtual Advisory Board Platform hosted in the European Union.

This policy complies with Regulation (EU) 2019/1150 and is binding for all employees, contractors, and third parties involved in the operation of MphaR Virtual Advisory Board Platform.

3. Definitions

  • Business User: Any natural or legal person using MphaR Virtual Advisory Board Platform for purposes related to their trade, business, craft, or profession.
  • Online Intermediation Services: Services provided by MphaR Virtual Advisory Board Platform as defined by Regulation (EU) 2019/1150.

4. Search Rankings

In accordance with Article 5 of Regulation (EU) 2019/1150, Medical Pharma Services, s.r.o. ensures that MphaR Virtual Advisory Board Platform does not provide or perform any search listing, does not offer any goods and services shown in a certain ranking.

5. Data Access

In compliance with Article 9 of Regulation (EU) 2019/1150, MedicalPharma Services, s.r.o. provides business users with access to certain datagenerated through their use of MphaR Virtual Advisory Board Platform.

  • Accessible Data: Business users can access data (Analytics’ reports) showing use of the Platform for a specific professional scientific event by invited healthcare professional participants through a secure dashboard on MphaR Virtual Advisory Board Platform.
  • Data Handling: All data is processed in accordance with Medical Pharma Services, s.r.o.'s Privacy Policy and applicable data protection laws, including GDPR.
  • Restrictions: Business users may not use accessed data for purposes outside the scope of their agreement with MphaR Virtual Advisory Board Platform.

6. Account Termination

Per Article 4 of Regulation (EU) 2019/1150, Medical Pharma Services, s.r.o. follows a fair and transparent process for suspending or terminating business user accounts on MphaR Virtual Advisory Board Platform

  • Notice Period: Except in cases of illegal activity, Medical Pharma Services, s.r.o. will provide at least 30 days’ written notice before suspending or terminating a business user’s account. The notice will include:
    • A statement of reasons for the suspension or termination.
    • Reference to the specific terms and conditions violated (if applicable).
  • Exceptions: Immediate suspension or termination may occur in cases of
    • Illegal activity, fraud, or violation of applicable laws.
    • Repeated breaches of MphaR Virtual Advisory Board Platform's terms and conditions.
  • Appeal Process: Business users may appeal a suspension or termination decision by contacting compliance@m-phar.com.

7. Complaint Handling and Mediation

Medical Pharma Services, s.r.o. maintains an internal complaint-handling system as required by Regulation (EU) 2019/1150.

  • Submitting a Complaint: Business users can submit complaints via compliance@m-phar.com. Complaints will be reviewed within 10 business days.
  • Mediation: If a complaint cannot be resolved internally, business users may pursue mediation through independent mediator.

8. Responsibilities

  • Compliance Officer: is responsible for overseeing compliance with this policy and Regulation (EU) 2019/1150.
  • Platform Administrators: Ensure that MphaR Virtual Advisory Board Platform operates in accordance with this policy.
  • Business Users: Must comply with MphaR Virtual Advisory Board Platform's terms and conditions and applicable laws.

9. Policy Review and Updates

This policy is reviewed annually or as required by changes in Regulation (EU) 2019/1150 or MphaR Virtual Advisory Board Platform's operations. Updates will be communicated to business users via email at least 15 days before taking effect.
